Five-star hotel development project overspend, more than £5 million recovered – professional negligence, breach of contract, conspiracy to defraud, claim against contractors.

The firm has recently been involved in successful commercial claims brought in The Technology and Construction Court on behalf of a Swiss-owned company arising out of a substantial costs overrun in the development of a five-star hotel. Claims in professional negligence, breach of contract and conspiracy to defraud were pursued against the client’s professional advisers and building contractors leading to a settlement prior to trial. This resulted in the recovery of more than £5 million.

Further success was obtained in a complicated arbitration claim against building contractors resulting in the recovery of substantial damages. Subsequently further litigation was brought against a firm of engineers for professional negligence in which a settlement was reached resulting in the recovery of substantial damages.

 

Damages recovered from local authority for negligence

Following a two-week trial in the Mercantile Court substantial damages were recovered on behalf of a well-established car dealership against a local authority for commercial losses arising out of damage caused to commercial buildings as a result of the negligence by the local authority. The case involved the extensive use of expert evidence including forensic accountancy, engineering and arboricultural evidence which paved the way to making a substantial commercial recovery.
